Based on the Korea Fair Trade Commission's Standard Terms and Conditions No. 10023 (Revised on June 26, 2015).

Article 1 (Purpose)

These Terms and Conditions are intended to define the rights, obligations, and responsibilities of Crazy Outdoor (the e-commerce operator) and users in connection with the use of the Internet-related services (the "Services") provided through the CLEM online shopping mall (www.clem.co.kr) (the "Mall") operated by Crazy Outdoor.

※ These Terms and Conditions shall also apply, where applicable, to electronic commerce conducted via PC communications, wireless devices, or other electronic means, provided that such application does not conflict with the nature of the relevant transaction.

Article 2. Definitions

① The term "Mall" refers to the virtual place of business established and operated by Crazy Outdoor, using information and communication facilities such as computers, to enable users to purchase goods or services (hereinafter referred to as the "Products, etc."). The term also refers to the business operator that manages and operates the online shopping mall.
② The term "User" refers to any member or non-member who accesses the Mall and uses the services provided by the Mall in accordance with these Terms and Conditions.
③ The term "Member" refers to a person who has registered as a member of the Mall and is entitled to continuously use the services provided by the Mall.
④ The term "Non-member" refers to a person who uses the services provided by the Mall without registering as a member.

Article 3. Display, Explanation, and Amendment of the Terms and Conditions

① The Mall shall display these Terms and Conditions, its trade name, the name of its representative, the business address (including the address for handling customer complaints), telephone number, fax number, email address, business registration number, mail-order business registration number, and the name of the person responsible for personal information protection on the main page of the CLEM online shopping mall (www.clem.co.kr) so that users can easily access such information. However, these Terms and Conditions may also be made available through a separate linked page.
② Before a user agrees to these Terms and Conditions, the Mall shall provide important information, including the conditions for order cancellation, delivery responsibilities, and refund policies, through a separate linked page, pop-up window, or other appropriate means to ensure that the user fully understands such information before giving consent.
③ The Mall may amend these Terms and Conditions to the extent that such amendments do not violate applicable laws and regulations, including the Act on the Consumer Protection in Electronic Commerce.
④ If the Mall revises these Terms and Conditions, it shall announce the effective date and the reason for the revision on the website at least seven (7) days before the effective date. However, if the revision is unfavorable to users, the Mall shall provide at least thirty (30) days' prior notice before the revised Terms become effective.
⑤ The revised Terms and Conditions shall apply to contracts concluded on or after the effective date. However, if an existing user requests the application of the revised Terms and the Mall agrees, the revised Terms may also apply to contracts concluded before the effective date.
⑥ Any matters not specified in these Terms and Conditions shall be governed by applicable laws and regulations, including the Act on the Consumer Protection in Electronic Commerce, and by generally accepted commercial practices.

Article 4. Provision and Modification of Services

① The Mall shall perform the following services:
1. Providing information on goods or services and facilitating the conclusion of purchase contracts.
2. Delivering goods or services for which a purchase contract has been concluded.
3. Any other services determined by the Mall.
② If goods or services become unavailable due to being out of stock or if their technical specifications are changed, the Mall may modify the details of the goods or services to be provided. In such cases, the Mall shall promptly notify users of the revised details and the date on which the changes will take effect.
③ If the Mall changes the content of the services it has agreed to provide, it shall immediately notify users of the reason for such change using an appropriate method of communication.
④ In the event described in the preceding paragraph, the Mall shall compensate users for any damages incurred. However, this shall not apply if the Mall proves that the change was not caused by its intentional misconduct or negligence.

Article 5. Suspension of Services

① The “Mall” may temporarily suspend the provision of services due to reasons such as maintenance, inspection, replacement, or malfunction of information and communication facilities including computers, or interruption of communication services.
② The “Mall” shall compensate users or third parties for any damages incurred due to service interruption caused by the reasons specified in Paragraph 1. However, this shall not apply if the “Mall” proves that there was no intention or negligence on its part.
③ If the “Mall” becomes unable to provide services due to reasons such as business conversion, abandonment of business, or merger between companies, the “Mall” shall notify users in accordance with the method specified in Article 8 and provide appropriate compensation.

Article 6. Membership Registration

① Users shall apply for membership by entering their personal information according to the registration form provided by the “Mall” and expressing their agreement to these Terms and Conditions.
② The “Mall” shall register applicants as members unless they fall under any of the following cases:
1. If the applicant has previously lost membership status (except where certain requirements are met)
2. If the registration information contains false information, omissions, or errors
3. If the “Mall” determines that registering the applicant as a member would cause significant technical difficulties in operating the service
③ The membership agreement shall be deemed established when the “Mall’s” acceptance reaches the member.
④ If any information provided during registration is changed, members shall notify the “Mall” of such changes within a reasonable period by updating their member information or through other appropriate means.

Article 7. Withdrawal from Membership and Loss of Membership Status

① Members may request to terminate their membership at any time, and the Mall shall process such requests without delay.
② The Mall may restrict or suspend a member's membership if the member falls under any of the following circumstances:
1. Providing false information when applying for membership.
2. Failing to pay for goods or services purchased through the Mall, or failing to fulfill any other financial obligations owed to the Mall by the due date.
3. Interfering with another person's use of the Mall or misappropriating another person's information, thereby disrupting the order of electronic commerce.
4. Using the Mall to engage in any activity prohibited by applicable laws, these Terms and Conditions, or generally accepted standards of public order and morality.
③ If the same violation is repeated two (2) or more times after the member's membership has been restricted or suspended, or if the cause of such restriction or suspension is not corrected within thirty (30) days, the Mall may terminate the member's membership.
④ If the Mall terminates a member's membership, the member's registration shall be canceled. In such case, the Mall shall notify the member and provide the member with at least thirty (30) days to present an explanation before the membership registration is canceled.

Article 8. Notification to Members

① If the “Mall” needs to notify members, it may do so through the email address designated by the member in advance with the “Mall”.
② For notifications to an unspecified number of members, the “Mall” may substitute individual notifications by posting the notice on the “Mall” website bulletin board for at least one week. However, matters that have a significant impact on an individual member’s transactions shall be notified separately to the relevant member.

Article 9. Purchase Application and Consent to the Provision of Personal Information

① Users of the “Mall” shall apply for purchases through the following or similar methods, and the “Mall” shall provide the following information in an easily understandable manner when users submit a purchase application.
1. Searching for and selecting goods, etc.
2. Entering the recipient’s name, address, telephone number, email address (or mobile phone number), etc.
3. Checking the terms and conditions, services for which the right of withdrawal is restricted, and information regarding costs such as shipping fees and installation fees
4. Indicating agreement to these Terms and Conditions and confirming or rejecting the above information (e.g., by clicking a mouse button)
5. Applying for the purchase of goods, etc. and agreeing to the confirmation of such application or the “Mall’s” confirmation
6. Selecting a payment method
② If the “Mall” needs to provide a purchaser’s personal information to a third party, it shall notify the purchaser of the recipient, purpose of use, items of personal information provided, retention period, and other relevant matters in accordance with applicable laws and obtain consent.
③ If the “Mall” outsources the processing of personal information, it shall disclose the entrusted party and the details of the outsourced tasks through its Privacy Policy or other appropriate means in accordance with applicable laws.

Article 10. Formation of Contract

① The “Mall” may refuse to accept a purchase application under Article 9 if any of the following cases apply:
1. If the application contains false information, omissions, or errors
2. If a minor purchases goods or services prohibited under the Youth Protection Act
3. If the “Mall” determines that accepting the purchase application would cause significant technical difficulties in operating the service
② The contract shall be deemed established when the “Mall’s” acceptance reaches the user in the form of a confirmation notification.
③ The “Mall’s” acceptance shall include information regarding the confirmation of the purchase application, availability of sales, and any changes or cancellations of the purchase application.

Article 11. Payment Methods

The payment methods for goods or services purchased from the “Mall” may be made through any of the following available methods:
1. Bank transfer
2. Payment by credit card, debit card, or prepaid card
3. Payment by virtual account deposit
4. Payment by electronic currency
5. Payment upon receipt
6. Payment using points
7. Payment using gift certificates
8. Other electronic payment methods
The “Mall” shall not charge users any additional fees for the use of their selected payment methods.

Article 12. Confirmation Notification, Changes and Cancellation of Purchase Applications

① The “Mall” shall send a confirmation notification to the user when the user submits a purchase application.
② If there is any discrepancy in the user's expression of intent after receiving the confirmation notification, the user may immediately request a change or cancellation of the purchase application after receiving the notification. The “Mall” shall process such requests without delay if they are made before shipment.
However, if payment has already been made, the provisions of Article 15 (Withdrawal from Purchase, etc.) shall apply.

Article 13. Provision of Goods, etc.

① Unless there is a separate agreement between the “Mall” and the user regarding the delivery period of goods, etc., the “Mall” shall take necessary measures such as order production and packaging so that the goods can be delivered within 7 days from the date the user places the order.
However, if the “Mall” has already received all or part of the payment for the goods, it shall take such measures within 3 business days from the date of receiving all or part of the payment.
At this time, the “Mall” shall take appropriate measures to allow users to check the delivery process and progress of the goods, etc.
② The “Mall” shall specify the delivery method, the party responsible for delivery costs for each method, and the delivery period for the goods purchased by the user.
If the “Mall” exceeds the agreed delivery period, it shall compensate the user for any damages incurred as a result.
However, this shall not apply if the “Mall” proves that there was no intention or negligence on its part.

Article 14. Refund

The “Mall” shall notify the user without delay if the goods, etc. requested by the user cannot be delivered or provided due to reasons such as being out of stock. If the “Mall” has already received payment for the goods, it shall refund the payment or take necessary measures for the refund within 3 business days from the date of receiving the payment.

Article 15. Withdrawal from Purchase, etc.

① A user who has entered into a contract for the purchase of goods, etc. with the “Mall” may withdraw from the contract within 7 days from the date of receiving the written details of the contract pursuant to the 「Act on Consumer Protection in Electronic Commerce, etc.」 (or from the date of receiving the goods if the delivery of goods, etc. has been delayed).
However, if applicable laws and regulations provide otherwise regarding the withdrawal of an offer, such provisions shall apply.
② The user may not return or exchange goods in the following cases:
1. If the goods, etc. have been lost or damaged due to reasons attributable to the user
(However, this shall not apply if the packaging has been damaged for the purpose of checking the contents of the goods, etc.)

2. If the value of the goods, etc. has significantly decreased due to the user's use or partial consumption
3. If the value of the goods, etc. has significantly decreased to the extent that resale is difficult due to the passage of time
4. If the packaging of goods, etc. that can be reproduced has been damaged
③ Even in cases falling under Paragraph 2, Items 2 through 4, the right of withdrawal shall not be restricted if the “Mall” has not taken measures such as clearly displaying the fact that withdrawal is restricted in advance so that consumers can easily recognize it or providing trial products.
④ If the contents of the goods, etc. differ from the details indicated or advertised, or if the goods are not provided in accordance with the contract terms, the user may withdraw from the purchase within 3 months from the date of receiving the goods or within 30 days from the date the user became aware of such fact.

Article 16. Effects of Withdrawal from Purchase, etc.

① If the “Mall” receives returned goods, etc. from the user, it shall refund the payment already received within 3 business days.
If the refund is delayed, the “Mall” shall pay delayed interest as prescribed in the Enforcement Decree of the 「Act on Consumer Protection in Electronic Commerce, etc.」.
② If the user has paid by credit card, electronic currency, or other similar methods, the “Mall” shall immediately request the business providing the payment method to suspend or cancel the claim for payment.
③ In the case of withdrawal from purchase, etc., the user shall bear the costs required for returning the goods, etc.
However, if the contents of the goods, etc. differ from the indicated or advertised details, or if the goods were not provided in accordance with the contract terms, the “Mall” shall bear the return costs.
④ If the user paid delivery fees when receiving the goods, the “Mall” shall clearly indicate who bears the delivery costs in the event of withdrawal from purchase so that the user can easily understand.

Article 17. Protection of Personal Information

① The “Mall” shall collect the minimum amount of personal information necessary to provide services when collecting users’ personal information.
② The “Mall” shall not collect information necessary for the fulfillment of a purchase contract in advance during membership registration. However, if identity verification is required before entering into a purchase contract to fulfill obligations under applicable laws and regulations, the “Mall” may collect the minimum amount of specific personal information.
③ When collecting and using users’ personal information, the “Mall” shall notify users of the purpose of such collection and use and obtain consent.
④ The “Mall” shall not use collected personal information for purposes other than those stated or provide it to third parties. However, exceptions shall apply where otherwise provided by applicable laws and regulations.
⑤ In cases where the “Mall” must obtain users’ consent, it shall notify users in advance of information such as the identity of the person responsible for personal information management, the purpose of collecting and using personal information, and matters regarding the provision of personal information to third parties. Users may withdraw their consent at any time.
⑥ Users may request access to their personal information and correction of errors at any time, and the “Mall” shall take necessary measures without delay.
⑦ The “Mall” shall limit the number of persons handling personal information to the minimum necessary for the protection of personal information and shall be responsible for damages caused by loss, theft, leakage, alteration, or other unauthorized incidents involving personal information.
⑧ The “Mall” or any third party that has received personal information shall destroy such personal information without delay once the purpose of collection or provision has been achieved.
⑨ The “Mall” shall not set consent boxes for the collection, use, or provision of personal information as pre-selected, and shall not restrict membership registration or service provision on the grounds that a user has refused to provide personal information that is not mandatory.

Article 18. Obligations of the “Mall”

① The “Mall” shall not engage in any activities prohibited by applicable laws and regulations or these Terms and Conditions, or contrary to public order and morals, and shall make every effort to provide goods and services continuously and reliably.
② The “Mall” shall establish a security system to protect users’ personal information so that users can safely use internet services.
③ If the “Mall” causes damages to users by engaging in unfair labeling or advertising practices regarding goods or services in violation of the 「Act on Fair Labeling and Advertising」, the “Mall” shall be responsible for compensating such damages.
④ The “Mall” shall not send commercial advertising emails for profit-making purposes to users who do not wish to receive them.

Article 19. Obligations Regarding Members’ IDs and Passwords

① Except for the cases specified in Article 17, members shall be responsible for the management of their IDs and passwords.
② Members shall not allow third parties to use their IDs or passwords.
③ If a member becomes aware that their ID or password has been stolen or is being used by a third party, the member shall immediately notify the “Mall” and shall follow any instructions provided by the “Mall”.

Article 20. Obligations of Users

Users shall not engage in any of the following activities:
1. Registering false information when applying for membership or making changes to registered information
2. Stealing or using another person's information without authorization
3. Altering information posted on the “Mall”
4. Transmitting or posting information (including computer programs, etc.) other than information permitted by the “Mall”
5. Infringing upon the intellectual property rights, including copyrights, of the “Mall” or any third party
6. Damaging the reputation of the “Mall” or any third party, or interfering with business operations
7. Disclosing or posting obscene or violent messages, images, audio, or other information that violates public order and morals

Article 21. Relationship Between the Linked “Mall” and the Connected “Mall”

① When a parent “Mall” and a subordinate “Mall” are connected through hyperlinks (including text, images, videos, etc.), the former shall be referred to as the linked “Mall” (website), and the latter shall be referred to as the connected “Mall” (website).
② If the linked “Mall” clearly indicates on its initial screen or through a pop-up screen displayed at the time of connection that it does not assume responsibility for transactions conducted between users and the connected “Mall” regarding goods, etc. independently provided by the connected “Mall”, the linked “Mall” shall not be liable for such transactions.

Article 22. Ownership of Copyrights and Restrictions on Use

① Copyrights and other intellectual property rights in works created by the “Mall” shall belong to the “Mall”.
② Users shall not use information obtained through the use of the “Mall”, for which intellectual property rights belong to the “Mall”, for commercial purposes by reproducing, transmitting, publishing, distributing, broadcasting, or using it in any other manner without the prior consent of the “Mall”, nor allow any third party to use such information.
③ If the “Mall” uses copyrights belonging to a user in accordance with an agreement, it shall notify the relevant user in advance.

Article 23. Dispute Resolution

① The “Mall” shall establish and operate a compensation processing organization to reflect legitimate opinions or complaints raised by users and provide compensation for damages.
② The “Mall” shall give priority to handling complaints and opinions submitted by users. However, if prompt processing is difficult, the “Mall” shall immediately notify the user of the reason and the expected processing schedule.
③ In the event of an electronic commerce dispute between the “Mall” and a user, if the user applies for damage relief, the parties may follow the mediation procedures of a dispute resolution organization designated by the Fair Trade Commission or a relevant city/provincial governor.

Article 24. Jurisdiction and Governing Law

① Any lawsuit arising from an electronic commerce dispute between the “Mall” and a user shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user’s address at the time the lawsuit is filed. If the user has no address, it shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user’s place of residence.
However, if the user’s address or place of residence is unclear at the time of filing, or if the user resides outside of Korea, the lawsuit shall be filed with the court having jurisdiction under the Civil Procedure Act.
② Korean law shall apply to any electronic commerce lawsuit filed between the “Mall” and a user.

Addendum

This Terms and Conditions shall take effect from the date of posting.
